Warranty - Terms and Conditions

PROFESSIONAL ROOFERS (a division of UXDU Contracting Inc.) offers one of the best residential and commercial warranties around.

Whereas most warranties cover only labour charges, leaving the customer to pay for material, tear off and disposal, Professional Roofers strives to go the extra mile and provide the customer with peace of mind and offers a non-prorated* warranty.

Our non-prorated* warranty covers: LABOUR, MATERIALS, TEAR OFF, and DISPOSAL.

If you have problems with your new roof and which relates to a defect in the materials. Professional Roofers will cover you according to the manufacturer’s warranty specifications for the materials we used on your house or building if the manufacturer fails to fulfil its own warranty for some reason other than the act(s) or default(s) of the customer.

ROOF SHINGLES: Our non-prorated* warranty is from 10 to 15 years depending on the package you choose when you sign the contract.

METAL ROOF: Our non-prorated* warranty is 15 years depending on the package you choose when you sign the contract. Our warranty does not cover animal damage, wind damage or any other acts of Mother Nature, discolouration, fading, corrosion, rust, fire, falling objects, or if the roof is mishandled, modified, or altered.

FLAT ROOF: We offer a five (5) year limited* warranty with respect to defects in installation.

EAVESTROUGH AND METAL WORK: We offer a five (5) year limited* warranty with respect to defects in installation and a twenty-five (25) year limited* warranty with respect to defects in materials.

SMALL REPAIRS: Normally we offer a one (1) year warranty for the area which we repair, only. However, if the problem occurs again during the one (1) year period, we are always willing to go back one more time to try and find a solution free of charge. If the problem continues thereafter, Professional Roofers will usually suggest a larger repair or new installation for which there will be an additional charge. If a whole new roof is required, the fee for the repair previously charged will be deducted from cost of the new roof.

*LIMITED WARRANTY – UXDU’s and Professional Roofer’s limited warranty only applies to damage to the shingles which have been installed by UXDU and which damage results directly from improper installation of the shingles by UXDU’s employees.

The limited warranty does not apply to defects in the shingles, nor does the limited warranty cover damage to the shingles caused by lifting or loosening of the shingles, or shingles being blown off or fall due to damage resulting directly or indirectly from wind, rain, sleet, hail or any other weather conditions. Any damaged caused by any one other than UXDU’s employees.

Other roofers second opinions will not be considered in our warranty. Any issues related with our work, must be notified to Uxdu Contracting Inc. (Professional Roofers). Defamation, slander, or bad propaganda, Professional Roofers reserves the right to nullify and terminate roof warranty and/or take legal action up to $200,000.00.

This limited warranty applies only to the supply and installation of shingles and does not cover any labor or material required with respect to the roof deck, roof trusses or rafters.

Roofcare+ Addon

I. INTRODUCTION

This Addon Contract ("Agreement") is effective as of the date of signing and receipt of the initial payment. This Agreement is between Professional Roofers ("Provider") and the individual identified as the "Customer." This addon is exclusively for residential properties owned by the legal owner and not representing a company or property management firm. Commercial properties are explicitly void under this Roofcare+ addon.

II. DEFINITIONS

- Force Majeure Event: Events beyond the reasonable control of either party, including but not limited to natural disasters, government actions, labor disputes, wars, or public disturbances.

III. COVERAGE TERMS

1. Eligibility: This addon is exclusively for residential properties owned by individuals, not under any company or property management.

2. Duration: This Agreement extends the Provider's original addon for a term of one (1) year, subject to renewal as outlined below.

3. Coverage Details: This Addon covers:

- Wind-inflicted damage – up to a maximum of $1,000 CAD.

- Animal-related damage – e.g., raccoons, squirrels, birds. Pest control must be contacted, and services rendered before any repair work commences. Up to a maximum of $1,000 CAD

4. Exclusions: This addon does not cover damages already covered under the Provider's original warranty.

5. Geographical Limitations: Services under this addon are restricted to the Province of Ontario, unless otherwise agreed in writing.

6. Service Restrictions: All repairs or replacements must be performed or approved by Professional Roofers. Unauthorized repairs will void this addon.

7. Structural damage: The Roofcare+ program does not cover any structural damage inflicted by weather conditions. (ex. Tree falls down as a result of high winds).

8. Roof Type: This addon does not cover any aluminum work or flat roofs.

IV. FINANCIAL TERMS

1. Monthly Premium: The Customer agrees to a monthly fee of $14.99 CAD plus applicable Harmonized Sales Tax (HST) (Annually $179.88 plus HST), payable upon entering this Agreement and on the same day of each subsequent month.

- Payment Terms: Roofcare+ is a monthly subscription. Failure to make the monthly payment will result in immediate cancellation of the addon coverage.

2. Annual Invoice: The Customer will receive an annual invoice summarizing all payments made throughout the year for record-keeping and tax purposes.

3. HST: All fees and charges under this Agreement are subject to applicable HST, which will be specified in the annual invoice.

4. Claim Deductible: A deductible of $197.00 CAD plus applicable HST will apply to each legitimate claim.

5. Compensation Ceiling: Claims are capped at $1,000 CAD plus applicable HST. For damages exceeding this amount, the Customer will be responsible for a deductible of $197.00 CAD plus any costs exceeding $1,000, both subject to applicable HST.

6. Cancellation Rights: Professional Roofers reserves the right to cancel this addon at any time by discontinuing the monthly payments. Notification of such cancellation will be provided to the Customer in accordance with applicable laws.

V. CUSTOMER RESPONSIBILITIES

1. Maintenance: The Customer must ensure regular roof maintenance. Failure to do so may void the addon.

2. Access: The Customer shall provide unhindered access to the property for the Provider to assess or repair damages.

3. Pest Control: Pest control services are not the responsibility of the Provider. All pests must be removed by a specialized pest control service before repair work begins.

VI. LIMITATIONS AND DISCLAIMERS

1. Third-party Liabilities: The Provider is not responsible for defects in materials or workmanship attributable to third parties or manufacturers.

2. Force Majeure: The Provider is not liable for non-performance or delays due to a Force Majeure Event.

VII. WARRANTY ASSIGNMENT

This warranty is non-transferable without the Provider's explicit written consent.

VIII. INDEMNITY

The Customer shall indemnify the Provider from damages or losses resulting from misuse of the roof, violations of this Agreement, or actions contrary to the addon's intent.

IX. LIABILITY RESTRICTIONS

The Provider shall not be liable for any indirect, consequential, or punitive damages.

X. CONFIDENTIALITY

Both parties agree to maintain the confidentiality of all proprietary information exchanged during the term of this Agreement.

XI. JURISDICTION & RESOLUTION

This Agreement is governed by the laws of Ontario. Both parties agree to use Alternative Dispute Resolution (ADR) as a preliminary remedy for disputes. Both Parties agree not to go to court but to settle this matter in ADR.

XII. ADDITIONAL TERMS

1. Entire Agreement: This Agreement constitutes the entire understanding between the parties, superseding all prior agreements.

2. Modifications: Changes to this Agreement must be in writing and mutually agreed upon.

XIII. CUSTOMER INFORMATION AND COMMUNICATIONS

1. Information Consent: By entering into this Agreement, the Customer consents to Professional Roofers collecting, storing, and using their personal information for the purposes of administering this addon and other related services.

2. Email Communications: The Customer agrees that Professional Roofers may send emails related to this Agreement, other services, and promotions. The Customer acknowledges that they can opt out of promotional emails at any time, but transactional and administrative emails related to this Agreement are mandatory.
